Remaining members of the Bali Nine could be released by year-end
The case regarding the potential release of the remaining members of the Bali Nine looks to be set for a resolution this month after Indonesia’s Coordinating Minister for Law, Human Rights, Immigration and Corrections, Yusril Ihza Mahendra met with Home Affairs Minister Tony Burke in Jakarta on Tuesday.
Professor Donald Rothwell, one of Australia’s leading experts in International Law, told Peter Fegan on 4BC Breakfast, “Indonesia’s made the offer, it’s now up to Australia to make sure that it happens from the Australian side, so to speak.”
“The difficulty that I see is that Australia and Indonesia don’t have a prisoner transfer agreement in place.
In other words, there’s no bilateral treaty that exists between the two countries that can actually facilitate this process,” Rothwell said.
“There’s nothing that came out of the meeting yesterday to indicate that a draft treaty is under negotiation.”
“Tony [Burke] is going to be coming back to Australia, working with Australian government lawyers to see what Australia can do on the Australian side to make this happen,” he said.
