Despite Kyrgios pleading guilty, his charge was dismissed by the judge due to the publicity of the trial, the amount of time that had elapsed since the incident and because it appeared to be a one-off incident, meaning the case did not warrant a conviction.
Kyrgios was charged over a late-night incident on January 10, 2021 following an argument with Ms Passari outside her apartment in inner-city Canberra.
The court today heard he pushed Passari to the ground. Ms Passari didn’t report the incident until 10 months later, when the couple split.
In a statement shared to social media, Kyrgios said he respects today’s ruling and is “grateful to the court for dismissing the charges without conviction”.
“I was not in a good place when this happened and I reacted to a difficult situation in a way I deeply regret,” he wrote.
“I know it wasn’t OK and I’m sincerely sorry for the hurt I caused.”
