Sacked workers scrutinised for ditching unfair dismissal claims
The Federal Attorney-General will consider sanctions against sacked workers who fail to follow through with unfair dismissal claims.
Employees have been accused of wasting the resources of the Fair Work tribunal and employers.
Employment Law expert Michael Byrnes tells Deborah Knight people often ignore their claims after they have filed them.
“It’s a bit of a disturbing trend.
“People treat the Fair Work Commission as a glorified complaints bureau.
“They don’t discontinue the proceedings… it leaves both the Fair Work Commission and the employer in a state of limbo.”
Council of Small Business of Australia CEO Peter Strong tells Deborah it wastes employers’ time.
“The better decision is to triage the complaints out at a much earlier stage.”
