A top Queensland lawyer is calling for the Crime and Corruption Commission to investigate the state’s Chief Magistrate and Attorney-General. 

Magistrate Ron Kilner could be removed from a domestic violence court case over controversial comments he made about the case in the media.

He claims Chief Magistrate Janelle Brassington labelled the comments “inappropriate” after the matter was brought to her attention by Attorney-General Shannon Fentiman.

Former president of the Queensland Law Society Bill Potts told Sofie Formica the conduct alleged by Dr Kilner requires investigation.

“How many times do we hear all manner of officials say they can’t comment while a trial is ongoing?” he asked.

“We hear that because the law, our law, says to do so is to interfere with the course of justice.

“That’s where there’s the real danger is: of justice being interfered with.”

A spokesperson for Ms Fentiman said she “categorically rejects any allegation of wrongful conduct in relation to the matter raised”.

“The Attorney-General did not make a complaint in any form to the Chief Magistrate, rather brought to her attention media reporting regarding comments made by Acting Magistrate Kilner.”

“As is the appropriate process with any such matter raised with the Attorney-General by the media or the public, it was forwarded on to the Chief Magistrate for consideration.

“The Attorney-General did not contact Acting Magistrate Kilner.”
